The Human Rights Division 1 of the Accra High Court has dismissed a judicial review application filed by suspended Chief Justice Gertrude Araba Sackey Torkornoo, describing it as an abuse of legal procedure and asserting that the court lacked jurisdiction to hear the matter.
Justice Torkornoo, currently facing impeachment proceedings under Article 146 of the 1992 Constitution, had sought a certiorari order to halt the inquiry. She argued that the process infringed on her fundamental human rights and challenged the legality and constitutionality of the committee overseeing her removal.
Her application followed three earlier failed injunction attempts at the Supreme Court, which aimed to pause the impeachment until the apex court could interpret the relevant constitutional provisions.
Presiding judge Justice Kwame Amoako ruled that the High Court was not empowered to intervene in the proceedings of a constitutionally mandated committee. He concluded that the application amounted to duplicative litigation and an improper use of judicial resources.
The ruling clears the way for the Justice Pwamang Committee to continue its inquiry into the petition for Justice Torkornoo’s removal.
