High Court Declares Abu Trica’s Certiorari Bid Moot, Applicant Re-Arrested

Following his discharge, Abu Trica returned to the High Court to pursue a certiorari application aimed at nullifying portions of the District Court’s proceedings.

At the High Court, representatives from the Attorney-General’s office contended that the motion was now irrelevant, pointing to the earlier termination of the prosecution and the applicant’s discharge.

Counsel for Abu Trica, Oliver Barker-Vormawor, argued that notwithstanding the withdrawal of the case, his client remained in custody—an outcome he described as highlighting “a disconnect between the letter of the law and its practical effect.”

Deputy Attorney-General, Dr. Justice Srem-Sai, assured the bench that if Abu Trica was indeed still being held despite the case’s discontinuation, measures would be taken to secure his prompt release.

The court eventually dismissed the certiorari application, ruling that once the applicant had been discharged, the matter before it had lost relevance.

Moments after the High Court session, however, Abu Trica was taken back into custody by state officials.
