High Court Dismisses Injunction Application Against Ablekuma North Election Rerun

The Accra High Court has thrown out a suit filed by Nana Akua Afriyie, the New Patriotic Party’s (NPP) parliamentary hopeful, which sought to halt a scheduled rerun in 19 polling stations in the Ablekuma North constituency.

The rerun, set for July 11, 2025 is part of the Electoral Commission’s efforts to bring closure to the disputed December 7, 2024, parliamentary elections in the area.

Presiding over the case, Justice Ali Baba Abature dismissed the application for an interim injunction, describing it as “unmeritorious.” He noted that the public interest was best served by allowing the Electoral Commission (EC) to fulfill its constitutional mandate of ensuring fair representation for the people of Ablekuma North.

Nana Akua Afriyie had argued that the EC’s decision to conduct a rerun contradicted a January 4, 2025, High Court ruling directing the Commission to compile results from 62 polling stations and declare a winner based on the existing votes.

Her legal team, led by Gary Nimako, referenced an official EC statement dated January 27 and a parliamentary briefing by Deputy EC Chair Dr. Bossman Asare, which indicated that only three polling stations had unresolved results.

Despite these claims, the court maintained that the EC’s constitutional obligation to complete the electoral process and safeguard voters’ rights outweighed the arguments presented.

With the case now dismissed, the Electoral Commission is free to proceed with the July 11 rerun, expected to determine the final outcome of the Ablekuma North parliamentary contest.
