Private lawyer Martin Kpebu is demanding the swift resignation of Special Prosecutor Kissi Agyebeng.
He argues that the Special Prosecutor’s handling of the high-profile Ken Ofori-Atta matter reflects a dereliction of duty and a betrayal of public confidence.
Appearing on Joy News’ PM Express on Wednesday, the outspoken Kpebu revealed that he had been summoned by the Office of the Special Prosecutor (OSP) but emphasized he was “not being investigated for any offence at all.”
According to him, the office only sought clarification on remarks he had made, which he explained were intended “to help the corruption fight.”
Kpebu then laid out the foundation of his critique.
In his words, “the most salient” issue is that “by now, the Special Prosecutor himself should have resigned.”
He noted that the OSP had “finally come to confess… on November 5” that before former Finance Minister Ken Ofori-Atta departed the country, “he, Kissi Agyebeng, intercepted the letter Mr Ofori-Atta wrote to both the incoming Chief of Staff and the outgoing ones.”
Kpebu stated that the Special Prosecutor admitted to intercepting the letter and then urgently sought assistance from security agencies.
“He said he intercepted the letter, then he ran to the National Investigations Bureau (NIB), but he didn’t get help, then ran to National Security, but didn’t get help there either, and finally he ran to the Ghana Immigration Service and still didn’t get help.”
He described this as a serious indictment of those institutions, but stressed that the greater lapse was the Special Prosecutor’s failure to speak out.
“Worst of all, it didn’t occur to the man who had done the ‘Ankwanuma’ press conference that he should blow the whistle,” Kpebu said.
He argued that the OSP should have “informed the people of Ghana through a press conference and say ‘Hey, people of Ghana, I’ve clear evidence Mr Ofori-Atta is about to travel out of Ghana and I’ve gone to these institutions, but they are not helping me.’”
Kpebu maintained that a public alert would have altered the situation entirely. “You know how many people would have taken steps to the airport to prevent him from travelling?” he asked.
He added that at the time he was part of the ORAL team, which “had security capos like Kofi Boakye” and others “in the back room” who could have acted if the information had been shared.
For Kpebu, the failure to raise the alarm is sufficient grounds for the Special Prosecutor to resign.
