Petition Filed to Remove Justice Kulendi Over Alleged Misconduct in Ambulance Case

A new petition has been filed demanding the removal of Supreme Court Justice Emmanuel Yonny Kulendi over claims of misconduct and conflict of interest in the ongoing ambulance procurement trial involving Minority Leader Dr. Cassiel Ato Forson.

The petitioner alleges that Justice Kulendi breached judicial ethics by engaging in matters linked to the prosecution of his cousin, even though he is not directly presiding over the case.

According to the complaint, Justice Kulendi is accused of improperly interfering in High Court proceedings in the case of Republic v. Cassiel Ato Forson & 2 Others.

“This conduct violates several provisions of the Code of Conduct for Judges and Magistrates and has eroded public confidence in the judiciary’s integrity, impartiality and independence, which are principles upon which the justice system is founded,” the petition states.

The petitioner further argued that the perception of divided loyalty by a Supreme Court judge, particularly in a case involving a close relative, undermines the credibility of the entire judicial system.

To support the claims, the petition included several attachments:

  • The High Court ruling in Accra dated June 6, 2024
  • The cross-examination of Richard Jakpa by the Republic in Republic v. Cassiel Ato Forson & 2 Others
  • WhatsApp exchanges between Richard Jakpa and the former Attorney-General and Minister for Justice
  • An affidavit filed by the Republic in the same case

The petition contends that these materials demonstrate a pattern of interference that threatens the independence of the judiciary and calls for Justice Kulendi’s removal under constitutional provisions.
