High Court Dismisses NDC’s Injunction Application

The High Court (General Jurisdiction 6) in Accra has dismissed an application for injunction filed by the National Democratic Congress (NDC) and Joana Gyan Cudjoe, seeking to restrain the Electoral Commission from printing ballot papers and notices of poll for the Amenfi Central Constituency .

Background of the Case

The NDC filed the suit in reaction to the Electoral Commission’s refusal to recognize Joana Gyan Cudjoe as the duly elected NDC parliamentary candidate for the Amenfi Central Constituency.

This was despite an earlier order by the High Court in Sekondi on May 31, 2024, directing the recognition.

Court Ruling

The High Court upheld the Electoral Commission’s decision, stating that it was in compliance with the pending orders from the High Court in Sekondi.

The court held that recognizing Joana Gyan Cudjoe as the candidate would be in contempt of the pending orders.

Implications of the Ruling

The dismissal of the application allows the Electoral Commission to proceed with printing ballot papers and notices of poll for the Amenfi Central Constituency. This development has significant implications for the electoral process in the constituency.
