Supreme Court Halts Kpandai Election Rerun

The Supreme Court has ordered the suspension of the scheduled parliamentary election rerun in the Kpandai constituency and instructed lawyers for New Patriotic Party (NPP) candidate Matthew Nyindam to serve court documents on the National Democratic Congress (NDC) candidate through substituted service.

The directive was issued on Tuesday after the apex court heard an application from Nyindam, who is contesting the Tamale High Court’s decision that nullified the December 7, 2024, parliamentary election in the constituency.

The case has been adjourned to January 13, 2026, for further proceedings.

Nyindam, the embattled MP, is urging the Supreme Court to overturn the High Court’s ruling, insisting that the lower court wrongly assumed jurisdiction in the election petition.

The petition was originally filed by the NDC’s candidate, Daniel Nsala Wakpal, who disputed the results of the 2024 polls.

Nyindam maintains that the petition was defective from the outset and that all subsequent proceedings should be voided. He argues that the High Court exceeded its authority and committed fundamental errors, warranting Supreme Court intervention through judicial review.

Following the annulment of the election, the NPP sought a stay of execution to prevent the Electoral Commission and the NDC from enforcing the ruling, including preparations for a rerun, until the Supreme Court delivers its verdict.

By suspending the rerun, the Supreme Court has effectively preserved the status quo while it examines the substantive issues raised in Nyindam’s application.
