Petitions Against EC Boss and Special Prosecutor Sent to Chief Justice

Minister of State for Government Communications, Felix Kwakye Ofosu, has confirmed that petitions calling for the removal of the Electoral Commission (EC) Chairperson, her two deputies, and the Special Prosecutor have been formally received and forwarded to the Chief Justice for further consideration.

Speaking on Joy Midday News, Kwakye Ofosu stated: “Every process that needed to be done has been undertaken. The process for doing so is quite clear. At this stage, the process has left the hands of the president beyond conveying the petitions to the Chief Justice. There’s little else that the president does in this particular instance. Everything now rests with the Chief Justice, who I believe will act in accordance with Ghanaian law.”

His remarks come after President John Dramani Mahama last week received 10 petitions demanding the removal of the heads of these key public institutions. Seven of the petitions target EC Chairperson Jean Mensa and her deputies — Dr Bossman Eric Asare, who oversees Corporate Services, and Samuel Tettey, responsible for Operations. The remaining three petitions seek the removal of Special Prosecutor Kissi Agyebeng.

Under Article 70(2) of the Constitution, the president, acting on the advice of the Council of State, appoints the Chairperson, Deputy Chairpersons, and members of the Electoral Commission.

The law further stipulates that the EC Chairperson and deputies enjoy the same terms and conditions of service as judges of the superior courts, with their removal procedures mirroring those applied to members of the judiciary. Specifically, the Chairperson’s conditions are equivalent to those of a Court of Appeal Justice, while the deputies’ terms align with those of High Court Justices.

Kwakye Ofosu assured the public that the Chief Justice will adhere to the proper legal framework in addressing the petitions.
