Minority Welcomes Supreme Court Verdict on Kpandai Seat

The Supreme Court of Ghana has overturned a High Court ruling that annulled the 2024 parliamentary election in Kpandai, effectively reinstating Hon. Matthew Nyindam as the duly elected Member of Parliament for the constituency.

In a 4–1 majority decision delivered on Tuesday, January 28, 2026, the apex court held that the Tamale High Court lacked jurisdiction to entertain the election petition, which was filed outside the statutory time limits. The ruling nullifies all proceedings related to the planned December 30 rerun and affirms Nyindam’s mandate as valid and lawful.

The Minority in Parliament welcomed the decision, describing it as a “systemic correction” that reinforces the principles of due process, electoral finality, and constitutional order. In a statement issued shortly after the ruling, the Minority called for the immediate withdrawal of any notifications suggesting the Kpandai seat was vacant and urged Parliament to review its internal procedures to prevent premature declarations in future cases.

They further criticised the Clerk of Parliament’s earlier letter to the Electoral Commission, which triggered preparations for a rerun despite pending appeals and a motion for stay of execution. The Minority cited past precedents—including the cases of Abodakpi, Sakande, Nyimakan, and Quayson—as examples of parliamentary restraint in similar legal disputes.

“The Supreme Court’s ruling vindicates our position,” the statement read. “It is a sobering lesson to all constitutional actors: Parliament must not move faster than the law; administrative letters must not outrun judicial processes.”

The Minority also acknowledged the legal team of Hon. Nyindam for their advocacy and expressed confidence that the full judgment, once released, will clarify key legal principles surrounding election petitions and jurisdiction.

With this ruling, the people of Kpandai retain their elected representative, and the constitutional balance between judicial oversight and respect for the electorate has been reaffirmed.
